15302, Class 2
Reasons for Exemption
In accordance with the California Environmental Quality Act, the replacement of an underground storage tank with an above-ground storage tank of the same size and capacity is categorically exempt pursuant to CEQA Guidelines Section 15302, Class 2. Exemptions under Section 15302, Class 2 consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.
