Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Class 4 (15304) Minor Alterations to Land
Reasons for Exemption
Consistent with example (i) within the definition of a Class 4 Categorical Exemption, the project constitutes fuel management activities within 30-100 feet of structures. It is intended to reduce the volume of flammable vegetation and will not result in-the removal of healthy, mature, scenic trees other than for forestry purposes, nor result in the taking of endangered, rare, or threatened plant or animal species or significant erosion or sedimentation of surface waters. This exemption applies to fuel management activities within 100 feet of a structure if, as here, the public agency with fire protection responsibility for the area has determined this is necessary due to extra hazardous fire conditions. None of the exceptions to the use of this categorical exemption cited in CEQA Guidelines Section 15300.2 apply to the project.
