Document Description
California Air Resources Board has established a certification process for evaporative emission control systems that are required for the control of small off-road engine evaporative emissions (SORE EE) as described in title 13, California Code of Regulations (CCR), section 2753. Section 2768 allows a manufacturer to apply for a variance from one or more SORE EE regulatory requirements when necessary to avoid extraordinary economic hardship beyond the reasonable control of the manufacturer, and allows a variance to be granted if specific findings can be made and if noncompliance is mitigated to the maximum extent feasible. Briggs & Stratton Corporation applied for a variance from the Carbon Canister Capacity Requirements, for its engine evaporative family No. BSXCMH002 for model years 2019, 2020, and 2021, on October 25, 2019.

Reasons for Exemption
Section 15061, subdivision (6)(3), because it can be seen with certainty that there is no possibility that the variance will have a significant effect on the environment. The issuance of the variance will not result in excess emissions as Briggs & Stratton will be required to fully offset such emissions through the certification averaging and banking program;
