Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2019-0320-R1, pursuant to Section 1602 of the Fish and Game Code to David Nava. The project is limited to 2 encroachments. Encroachment 1 is for the removal of an existing unpermitted water diversion from an unnamed tributary to Grindstone Creek. Work for this encroachment is limited to removing the ¾ inch intake pipe and plastic sheeting that was placed in the channel and covered with loose cobbles. The other proposed encroachment is to remove fill and slash that was graded into the headwaters of an unnamed tributary of Grindstone Creek. Slash and approximately 62 cubic yards of fill (20 feet by 28 feet by 3 feet deep) will be removed from the channel, restoring the channel to natural grade. The re-established channel will be stabilized with appropriately sized rock. Surrounding disturbed areas will be planted with native seed and treated with erosion control measures as necessary.

Reasons for Exemption
These projects are conducted in accordance with published guidelines of the Department of Fish and Game, the primary purpose is to improve habitat for amphibians or native fish. The two projects first to remove point of diversion infrastructure and second to remediate a channel will allow passage of aquatic life within full channel and streambed free of nonnative materials and sediment. Therefore, the site-specific conditions will be improved as a result of removing slash and fill from the headwaters of Grindstone Creek. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065.
