Reasons for Exemption
CEQA requires analysis of agency approvals of discretionary "projects." A "project," under CEQA, is defined as "the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment" (State CEQA Guidelines Section 15378). The proposed project is a project under CEQA.
State CEQA Guideline Section 15301 (existing facilities). Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The project is a CUP to allow for a 1,204 sf "assembly use" for a religious facility and accessory uses within an existing 4,387 sf building in the RD-20 Zoning district. The remainder of the building would be utilized for offices, classrooms, restrooms, and kitchen facilities. The project also includes associated site improvements including parking and lighting, on the previously-developed 0.94 acre project site. No special circumstances exist that granting a CUP would create a significant adverse effect on the environment. Therefore, the proposed project qualifies for the exemption under state CEQA Guidelines sections 15301 and no further environmental review is required.
