Document Description

A minimum lot size overlay zone shall be applied to prohibit the future division of a future dwelling pursuant to the allow "homestead" split.

The project is exempt under the general rule that CEQA applies only to project which have the potential for causing a significant effect on the environment and meets the criteria set forth in the California Code of Regulations Article 15 Section 15061(b)(3)
1) The subdivision of the property to create an additional parcel for the existing residential use is essentially allowed as a use by right per 18.18.070;
2)The rezone to AE from U is required to confer to existing and allowed uses per the General Plan;
3) The rezone to the M Overlay Zone is a restrictive action which does not allow for additional subdivision per 18.18.070A.4;
4) The proposed project, activity, and use is supported by the Modoc County General Plan for Agricultural Land Use;
a) The plan recognizes the separation of the homestead from the farm as an Issue;
b) The plan recognizes his activity as a Goal;
c) The plan lists the activity as a policy;
d) The plan lists the activity as part of the action program to be includes in the zoning ordinance.
