Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement Number 1600-2017-0464-R1, pursuant to section 1602 of the Fish and Game Code to Lawrence and Cynthia Winter.
This project is limited to 2 encroachment. Both encroachments are for water diversion. One encroachment is from the South Fork Trinity River at an estimated current rate of 40 gallons per minute using an inline gas powered pump with properly screened intake. Under this agreement the diversion rate must be reduced to 10 gpm. The pump currently diverts water along a 2 inch PVC pipe for storage in an 800-gallon tank and is used for non-cannabis domestic irrigation of lawn, garden, and trees and cannabis cultivation during the spring, summer and fall, when the well water level no longer supports outside irrigation. The second encroachment is diversion at an approximate rate of 10 gpm using an electric shallow well jet pump 3/4 horsepower, from a jurisdictional, excavated well. Well water is currently diverted using a 1 inch pvc pipe to the household and to non-cannabis and cannabis irrigation. Water will be diverted as needed seasonally from both sources and to meet all domestic household, non-cannabis irrigation and 2,500 square feet cannabis cultivation needs under the condition described in the agreement.
