Document Description
Pursuant to PRC Section 25402.1(h)(2) and section 10-106 of title 24 of the code of regulations, Davis has applied to Energy Commission for a determination that its locally adopted energy efficiency standard, enacted in local ordinance 2512, will require buildings to be designed to consume no more energy than permitted by the energy commission's building energy standards are set forth in title 24, part 6 of code of regulations. The ordinance will require all new single fam res to be 30% more energy efficient and all new multifam dwellings to be 25% more energy efficient that required by the 2016 energy standards. These compliance margins correspond to meeting CALGreen Tier 2 for energy efficiency. The city will require that these targets be met by a combination of additional energy efficiency measures as well as installation of solar PV where solar PV size is determined by the amount which would offset 80% of estimated building electricity use for a combined fuel residence. Consistent with PRC Section 25402.1(h)(2), the energy commission found that the city will require the diminution of energy consumption levels permitted by the 2016 energy standards.

Reasons for Exemption
The city of Davis' ordinance will require the diminution of energy consumption levels permitted by the 2016 Energy Standards, involves the comparison of the energy savings of the ordinance pursuant to an objective fixed standard, and does not require the exercise of judgement or deliberation on the part of the energy commission. It is therefore a ministerial act consistent with section 15369 of title 14 of the CA Code of regulations, and is exempt from CEQA.
