Document Description
The project is for KWBA to acquire fee title to the property identified by the above-referenced APN, consisting of about 159.29 acres located adjacent to KWBA's existing Kern Water Bank lands. The project is limited to entering into agreements for and acquisition and ownership of the property by KWBA. The purpose of project is to allow KWBA to conduct studies and/or otherwise explore the opportunity to use the property as part of or in relation to its nearby Kern Water Bank project in the future. Any future use or development of the property by the district is conditioned on and subject to separate compliance with CEQA. Beneficiaries of the project are the member entities of the KWBA and their respective landowners and water users.

Reasons for Exemption
The project involves the acquisition of about 159.29 acres of real property. The project does not involve the construction or alteration of any facilities or any change in existing uses of the property by the KWBA, except for possible minor alterations to facilities or to the condition of the property and activities associated with maintenance of the property which activities are exempt from CEQA. The property will be maintained in substantially its present use and condition until such time as specific plans for future use are developed and considered by the KWBA. Any future use or development of the property by KWBA is conditioned on and subject to separate review for compliance with CEQA. Additionally, the project is not subject to CEQA as it involves designation of a preferred site for CEQA review and entry into land acquisition agreements conditioning the District's future use of the site on CEQA compliance. Moreover, in light of the foregoing, KWBA has determined that the project is exempt b/c it can be seen with certainty that there is no possibility that acquisition of said property may have a significant effect on the environment.
