Violation Restoration and Channel Rehabilitation (Lake or Streambed Alteration Agreement No. 1600-2016-0134-R1)

CDFW has executed Lake or Streambed Alteration Agreement No. 1600-2016-0134-R1, pursuant to section 1602 of the fish and game code to Ms. Diane Davis Owner. The project is limited to restoration of a watercourse that was altered during the winter of 2015 without CDFW authorization. When unauthorized work was first discovered, there were two ponds that had been excavated in the stream channel with a backhoe, and there was a small dam upstream of the upper pond with water being piped into the excavated area while dewatering the section of stream between the dam and upper pond. There was loose, unconsolidated soil around both ponds and no spillway connecting the lower pond back to the original channel. In the year since the initial violation occurred, the stream course has changed again, either through high flows during winter or additional equipment work. The notification describes the current project footprint as 38 lf of affected watercourse in a straight channel, about 1.5-2 ft wide at the base, and 3-5 ft deep from the natural ground level with nearly vertical banks. This agreement will authorize final work to restore the stream channel and alleviate further impacts from unauthorized work, which delivered loose sediment to Little Browns Creek, a perennial stream that has coho salmon, steelhead, and foothill yellow legged frog.
