Tejon Mountain Village Project (California Endangered Species Act Incidental Take Permit No. 2081-2011-084-04 (ITP))

The project as approved by the California Department of Fish and Wildlife (CDFW) consists of a minor Amendment to the California Endangered Species Act (CESA) ITP referenced above as originally issued by CDFW to Tejon Mountain Village, LLC (Permittee) for the Tejon Mountain Village Project in July 2013. The ITP as originally issued authorizes take of the state threatened Tehachapi slender salamander (Batrachoseps stebbinsi) and the state endangered least Bell's vireo (Vireo bellii pusillus), willow flycatcher (Empidonax traillii), and western yellow-billed cuckoo (Coccyzus americanus occidentalis); species designated as threatened and endangered, respectively, under CESA. The Amendment as approved revises Condition of Approval 10.3 of the ITP to state that the Security will be provided prior to the initiation of Covered Activities. Other revisions were made to the ITP to protect the Cuddy Creek Wetland Mitigation Security and the funds necessary for management of Habitat Management lands against inflation by annually adding the rate of inflation as determined by the United States Bureau of Economic Analysis's Gross Domestic Product Implicit Price Deflator to the 2012 cost estimates until for the year Covered Activities will be initiated. CDFW issued the original ITP and approved the Amendment as a responsible agency under the California Environmental Quality Act (CEQA) relying on an Environmental Impact Report (EIR) prepared and certified for the Project by the lead agency, County of Kern.
