Document Description
The Operator proposes to alter the streambed by removing silt, sand, debris, vegetation and other obsructions to flow and performing minor, in-kind repairs to existing facilities to maintain their functional integrity. Of the 26 facilities that require maintenance (Final Project List, 2002), 19 are completely modified channels (concrete sides and bottom), 2 are partially modified channels (concrete sides, earthen bottom), and 5 are unmodified channels/debris basins (earthen banks and bottom). Native vegetation removal is restricted by density, total area, and tree size (dbh) as defined in the Agreement. All work shall be performed in a manner and time to avoid and minimize potential impacts to wildlife. No work shall be performed where listed or sensitive species may occur within or adjacent to the project footprint. Total permanent impacts at the 26 sites shall not exceed 0.48 acres. The Operator shall create or restore1.37 acres of native vegetation/habitat on-site or transfer funds to a third part to carry out the restoration/creation. The Department shall make the final determination in writing which projects on the Final Project List may be implemented. Maintenance projects required in subsequent years shall be provided to the Department of approval and shall be amended into the Agreement.
