Document Description
The project is the implementation of the amended Purchase Agreement (PA) between the Novato Public Finance Authority (NPFA) and the Master Developer for the Hamilton Army Airfield Reuse Plan. The PA has been amended to exclude an approximate 2.2- acre site located in the primary Exchange Triangle site north and east of Lanham Village and which previously contained a gas station. Due to ongoing remediation of hazardous contaminants associated with the historic use of the site as a gas station, transfer of the 2.2-acre site would not be included in the PA. The site would be transferred at a later date upon completion of site remediation, as determined by the California Regional Water Quality Control Board (RWQB). As the proposed project would be solely a financial transaction, the project would result in no environmental impacts, pursuant to Section 21065 of the State CEQA guidelines.

The NPFA is authorized to amend a PA and to take actions necessary to the transfer of Property under the Agreement of Purchase and Sale (December 13, 1999), as amended by escrow instructions. NPFA is not authorized to agree to a subsequent conveyance of the 2.2 acre gas station parcel of the Property unless there are assurances provided that NPFA will not incur increase costs or liability in association with and environmental conditions associated with that parcel remaining at the time of transfer. The project amends a purchase agreement to exclude a 2.2-acre site.
