Document Description
The Department of Toxic Substances Control (DTSC) seeks to approve an Explanation of Significant Difference (ESD) pursuant to authorization granted under Section 117 of the Comprehensive Environmental Response, Compensation, and Liability Act and 40 Code of Federal Regulations Section 300.435(c)(2)(I). Preparartion of the ESD is requires because recent site remediation activities revealed the need for removal of additional volumes of contaminated soils from the site beyond volumes estimated in a remedial action plan (RAP) approved vy DTSC in 1998. While these increases change the scope of the project as previously approved, they do not fundamentally alter the remedy selected in the 1998 RAP, thus not requiring a formal RAP amendment. The proposed change includes transporting 5,500 cubic yards of contaminated soil to landfill designed to accept the waste. This soil will be transported, in acccordance with applicable state, federal and local environmental laws and regulations.
