Document Description
Zoning Agreement and Use Permit Amendments, as required by condition 45 of the Zoning Agreement Number 5269, to reflect the conditions of the secured Corps of Engineers permit. The proposed changes are as follows: (1) The elimination of mining in Laguna Creek. The Laguna Creek Corridor will now be preserved (Plate B, Current Reclamation Plan). The new proposal eliminates the mining of 23 acres in the original Phase III of the project. (2) Phase III is now proposed to be mined simultaneously with the new Phase X. (3) The mining phases have been renumbered to reflect the elimination of most of the original Phase III and the phases have been renumbered to reflect 10 phases (Plate C, Current Mining Plan). (4) The Laguna Creek Floodplain will now be preserved and contained by flood control berms. (5) Drainage from the north of Jackson Highway will now bypass the mined phases. (6) Phase I and Phase II will now be filled to approximate original grade (Plate B, Current Reclamation Plan). (7) The original Phase IX excluded mining of a five-acre parcel on Eagles Nest Road.
